LiftIQ Terms of Use

1. Acceptance of Terms

By accessing or using LiftIQ software, applications, or related services, you agree to be bound by these Terms of Use. If you do not agree with these terms, you may not use LiftIQ products or services.

LiftIQ LLC ("LiftIQ") reserves the right to update or modify these terms at any time without prior notice. Continued use of LiftIQ products after any such changes constitutes your acceptance of the revised terms.

2. Qualified Use

LiftIQ software and documentation are intended for use by qualified elevator personnel and related professionals. By using LiftIQ products, you represent that you are trained, authorized, and operating under your employer's safety policies and applicable jurisdictional codes.

LiftIQ tools provide diagnostic guidance and educational support only. They are not a substitute for field experience, supervision, or safe work practices.

3. Purpose and Limitations

LiftIQ products offer guidance, diagnostics, and informational support based on factual technical data, lawful study, and field-verified procedures. LiftIQ does not provide instructions to override safety systems or to perform work that violates code, law, or employer policy.

All outputs and recommendations are informational only. Users must evaluate all conditions and make independent decisions in accordance with their training and company rules.

4. Safety and Compliance

LiftIQ incorporates the Safety-as-Final-Lens framework and the Final Nine safety principles in all of its systems. All users must follow their own company safety program, OSHA regulations, and applicable codes before performing any work.

LiftIQ emphasizes:

• De-energization whenever possible.
• Energized testing only when required for accurate troubleshooting and under qualified supervision.
• Proper use of PPE, lockout-tagout procedures, and fall protection.

LiftIQ tools are designed to reinforce safety awareness—not enforce compliance.

5. Intellectual Property

All LiftIQ materials, including software, documentation, manuals, AI outputs, and protocols, are the exclusive property of LiftIQ LLC. No portion of LiftIQ products or content may be copied, distributed, modified, reverse-engineered, or republished without express written permission from LiftIQ LLC.

You may not use LiftIQ trademarks, logos, or names in a manner that implies endorsement or affiliation without authorization.

6. Disclaimer of Warranties

LiftIQ products and services are provided "as is" and "as available." LiftIQ makes no warranties, expressed or implied, regarding the accuracy, reliability, or suitability of its software or documentation for any purpose.

Use of LiftIQ products is at your own risk. LiftIQ does not guarantee that its systems will identify or correct all equipment faults or prevent equipment damage or injury.

7. Limitation of Liability

To the fullest extent permitted by law, LiftIQ LLC, its affiliates, officers, and employees shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:

• Use or inability to use LiftIQ products.
• Errors, omissions, or inaccuracies in LiftIQ content.
• Any acts or omissions by technicians or employers while using LiftIQ products.

LiftIQ's total liability for any claim shall not exceed the amount paid (if any) for access to the specific product or service in question.

8. Arbitration and Governing Law

Any disputes arising from the use of LiftIQ products or services shall be resolved by binding arbitration in accordance with the laws of the State of Texas. Venue shall be Collin County, Texas, unless otherwise mutually agreed.

By using LiftIQ products, you waive the right to a jury trial or class action participation.

9. Termination

LiftIQ reserves the right to suspend or terminate user access at any time for any reason, including violation of these Terms of Use or misuse of its products.
